A man caught with almost €600 of cocaine in his car can avoid a conviction – if he pays a contribution to charity.
Ryan Kellie appeared before Letterkenny District Court.
The court heard that on July 28th, 2022, Gardai observed a car at Lower Main Street in Letterkenny.
It traveled at speed before parking in the car park at the Aura Leisure Centre at Ballymacool.
Gardai searched the car under the Misuse of Drugs Act and found a white powder substance in a bag in the car.
Upon analysis, Gardai said the substance was cocaine and had a value of €574 although the accused said he had bought it for €300.
Solicitor for the accused, Mr Rory O’Brien said his client, of Mullantiboyle, Glenties, accepted the details and said the cocaine was being used for his own recreational purposes.
The court heard that Kellie has no previous convictions.
Mr O’Brien asked, considering this was a Section 3 charge, if the court would be open to allowing Kellie to avoid a conviction if he made a donation to a charity.
Judge Eiteain said the accused was getting only one opportunity (to avoid a conviction).
Kellie was ordered to pay €650 to the Letterkenny Youth Diversion Programme and the case was adjourned until June 24th to allow the payment.
