Man found drunk beside crashed car is banned for four years

A man who crashed his car after he had been drinking has been put off the road for four years.

Alan Vial appeared at Letterkenny District Court following the incident on June 26th last.

The court was told the 38-year-old has crashed his VW Passat and was found at the opposite side of the road from the crash.

Gardai suspected Vial, of Drumanoo Head, Killybegs, had consumed an intoxicant but he became aggressive and was arrested under Section 4 (8) of the Road Traffic Act 2010.

He was taken to Letterkenny Garda Station and a designated nurse was called in an attempt to take a blood sample from Vial but he refused to cooperate.

His solicitor, Mr Patsy Gallagher, said his client had no previous convictions for similar incidents.

He said his custody was on remand for other matters but since going into custody his health and condition have improved.

He said Vial is now considered a model prisoner and has immersed himself back into education and is also working in the prison kitchen.

Mr Gallagher asked the court to take a “certain course’ in the matter saying his client “knows his future.”

Judge Eiteain Cunningham convicted Vial for failing to give a sample, fined him €300 and disqualified him from holding a driving license for four years.
